Privacy Notice

1. Who we are

OkayDivorce is operated by Artagia Inc., a corporation registered in Canada ("Artagia", "we", "us", "our"). Artagia Inc. is the data controller responsible for personal data collected through okaydivorce.ca, okaydivorce.com, and related services (the "Service").

2. Categories of personal data we collect

  • Account data — name, email address, login credentials.
  • Profile and case data — information you enter into assessments, the Form 13.1 builder, the support calculator, the counterpart profile, the document vault, and AI Counsel conversations.
  • Communications — messages you send to support or to a coach booked through the Service.
  • Usage and device data — pages visited, features used, device identifiers, IP address, browser type, approximate location derived from IP.
  • Payment-related identifiers — order IDs and subscription status returned by our payment processor. We do not store full card numbers.

3. How we use your data and our legal basis

  • To provide the Service — creating your account, running assessments, generating documents, powering AI Counsel (contract performance).
  • To process payments and manage subscriptions — via our Merchant of Record, Paddle (contract performance, legal obligation).
  • To secure the Service — fraud prevention, abuse detection, account security (legitimate interests).
  • To improve the product — anonymous/aggregated analytics (legitimate interests).
  • To provide customer support — responding to your messages (contract performance).
  • To send service and marketing emails — service emails on a legal basis of contract; marketing only with consent, which you can withdraw at any time.

4. Who we share your data with

  • Paddle.com Market Limited — our Merchant of Record. Paddle handles all payments, billing, tax compliance, invoicing, refunds, and customer service inquiries relating to transactions. See Paddle's privacy policy.
  • Discreet billing — charges on your card or bank statement appear as a neutral payment-processor descriptor (currently PADDLE.NET* OKAY CA), not as "divorce", "separation", or "legal services". This protects financial privacy during a separation.
  • Service providers (sub-processors) — hosting, database, email delivery, analytics, and AI model providers used to operate the Service. These providers are contractually limited to using your data only to deliver services to us.
  • Coaches and professionals you choose to engage — only the specific information you choose to share through the Service (e.g. a vault share link, a booking).
  • Professional advisers — our legal, accounting, and compliance advisers where reasonably necessary.
  • Authorities — where required by law or to protect rights, safety, or property.

We do not sell your personal data.

5. Where your data is stored

Account and case data is stored on Canadian infrastructure. Some sub-processors (including Paddle and certain AI providers) may process data outside Canada. Where they do, we rely on contractual safeguards required under applicable Canadian privacy legislation.

6. How long we keep your data

We keep account and case data for as long as your account is active and for a reasonable period afterwards to handle disputes, comply with legal obligations, and maintain backups. When you delete your account, your case data is deleted or anonymised within 90 days, except where retention is required by law.

7. Your rights

Under Canadian privacy law (PIPEDA and applicable provincial laws), you have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate or incomplete data.
  • Withdraw consent and request deletion of your data.
  • Receive a copy of your data in a portable format.
  • Complain to the Office of the Privacy Commissioner of Canada or your provincial privacy regulator.

To exercise any of these rights, email privacy@okaydivorce.ca. We will respond within 30 days.

8. Security

We use appropriate technical and organisational measures including encryption in transit and at rest, access controls, and audit logging. No system is perfectly secure; we cannot guarantee absolute security but we take this responsibility seriously.

9. Cookies

We use strictly necessary cookies to keep you logged in and to remember your preferences. We use limited analytics cookies to understand how the Service is used. You can manage cookies through your browser settings.

10. Changes to this notice

We may update this notice from time to time. Material changes will be notified by email or in-product notice.
